Supplemental AI Terms

PlexTrac offers AI features that provide assistance in automated generation of content within the reporting workflow (“PlexTrac AI”). This includes but is not limited to report narratives, finding descriptions, and finding recommendations. Your use of PlexTrac AI is subject to these supplemental terms of use (“Terms”). By using PlexTrac AI, you agree to be bound by these Terms.


1.         Definitions. 

Input Data means end-user supplied information to PlexTrac AI e.g. security findings and vulnerability data entered in the PlexTrac platform.

Output Content means generative AI responses resulting from end-user submissions to the PlexTrac AI system.

All other defined terms shall have the meaning set forth in the PlexTrac Commercial Terms of Use

2.         Provision. PlexTrac AI IS PROVIDED “AS-IS,” “WITH ALL FAULTS,” AND “AS AVAILABLE”. PlexTrac, Inc. (PlexTrac) makes no guarantees or promises about how PlexTrac AI operates or that it will function as intended.

3.         Eligibility and Use.  

a.  If you are provisioned with an instance of the PlexTrac platform license that includes PlexTrac AI  access, PlexTrac AI will automatically be made available to you.  In such instances, any user interface elements and API endpoints relative to use of PlexTrac AI will be visible to you as a licensed platform user in their entirety.

b. Along with these Terms, your use of PlexTrac AI is also governed by PlexTrac’s Commercial Terms of Use, which is incorporated by reference. You agree that the furnishing of PlexTrac AI constitutes a Service, as defined in the Commercial Terms of Use. If there’s any actual conflict between these Terms and the Commercial Terms of Use, the conflicting provision in these Terms will control as to the subject matter.

4.         Using . Your use of the PlexTrac AI may allow you to submit text inputs and converse with an online computer-powered chatbot and in certain circumstances generate text content. Your use of the PlexTrac AI shall comply with these Terms and PlexTrac’s Commercial Terms of Use.

5.       Data.  All data processed PlexTrac AI, will be processed according to the PlexTrac Privacy Statement.  Any data submitted to PlexTrac AI exists within PlexTrac AI for the life cycle of generating content.  PlexTrac AI does not persist or learn from submitted data.

6.         Intellectual Property. As the User of the PlexTrac AI you’re responsible for respecting, and should not break nor otherwise infringe on any copyright protections of any third party.

7.         Ownership of Content. PlexTrac does not claim ownership of any content you provide, post, input, or submit to, or receive from, PlexTrac AI (including any feedback and suggestions (collectively, “Feedback”) you may provide). You are required to make your own determination regarding the intellectual property rights you have in output content and its commercial usability, taking into account, among other things, your usage scenario(s) and the laws of the relevant jurisdiction. You warrant and represent that you or your organization owns or otherwise controls all of the rights to your content as described in these Terms including, without limitation, all the rights necessary for you to provide, post, upload, input, or submit the content.  Further, you agree that any Feedback provided by you to PlexTrac in connection with your use of PlexTrac AI shall not be treated as confidential, and nothing in these Terms will restrict PlexTrac’s right to use, profit from, disclose, publish or otherwise exploit any Feedback provided, without compensation to you.

8.         Excessive Use.

a. Excessive Usage Defined.  PlexTrac AI is designed to assist users in summarizing large volumes of data efficiently. However, excessive usage may strain system resources, impact performance, and hinder the experience for other users. To maintain fair access and optimal service quality, we define “excessive usage” as any activity that significantly exceeds normal usage patterns.
b.  Right to Limit or Disable Usage.  PlexTrac reserves the right to monitor usage patterns and take appropriate action if we determine that a user’s activity falls into the category of excessive usage. Such actions may include:

  • Rate Limiting: We may limit the number of requests or summaries a user can generate within a specific time frame.
  • Temporary Suspension: In cases of severe misuse, we may temporarily suspend a user’s access to PlexTrac AI.
  • Permanent Disablement: If repeated excessive usage persists despite warnings, we may permanently disable a user’s access to PlexTrac AI.

c. Fair Use Guidelines. We encourage users to utilize PlexTrac AI  responsibly and consider the following fair use guidelines:

  • Reasonable Volume: Use PlexTrac AI for reasonable data volumes relevant to your intended purpose.
  • Avoid Automated Scraping: Do not automate requests or use PlexTrac AI for large-scale data scraping.
  • Respect System Resources: Avoid overloading the system by making excessive requests in a short period.

d. Reporting and Appeals. If you believe your usage has been unfairly restricted or disabled, you can contact our support team to appeal the decision. We will review each case individually and make adjustments if warranted. By using PlexTrac’s AI data summarization tool, you agree to abide by this excessive use provision. Failure to comply may result in limitations or termination of your access.

9.         Third-party claims. You are responsible for responding to any third-party claims regarding your use of PlexTrac AI in compliance with applicable laws (including, but not limited to, claims of copyright infringement or other claims relating to output content that was generated during your use of PlexTrac AI).

10.       Reverse engineering. You may not use PlexTrac AI or any other means or methods to discover any underlying components of the models, algorithms, or systems, such as exfiltrating the weights of models on which the PlexTrac AI is based. 

11.      Extracting Data. You may not use web scraping, web harvesting, or any other web data extraction method to extract data from PlexTrac AI or from any output content.
12.      Dispute Resolution. Any controversy or claim arising out of, or relating to the subject matter of these Terms, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitration shall be conducted by a single arbitrator appointed in accordance with the AAA rules. The arbitrator shall have the authority to conduct the proceedings by telephonic or video appearance, as deemed appropriate.  INTERNATIONAL USERS WAIVER: BY AGREEMENT TO THIS ARBITRATION CLAUSE, INTERNATIONAL USERS EXPRESSLY WAIVE ANY ARGUMENTS OR DEFENSE BASED ON INTERNATIONAL LAW, INCLUDING THE UNITED NATIONS CONVENTION ON CONTRACTS FOR THE INTERNATIONAL SALE OF GODS (CISG) OR ANY OTHER SIMILAR INTERNATIONAL TREATY OR CONVENTION.
